Forbidden Products

Firearms
The use of Mercado Pago for the sale of firearms is forbidden. Any device that uses the gunpowder energy to launch a projectile from afar shall be considered to be a firearm. This rule includes weapons used in sports, antiques, collector's pieces, whether in shooting condition or not, and whether for the exclusive use of the Armed Forces or not.
The prohibition is likewise applicable to: ammunition, cartridges, mufflers and any accessories, such as flamethrowers, lethal gas, mustard gas, tear gas and explosives in general.
Other weapons
The sale of devices or weapons that shoot lethal projectiles using the payment management services of Mercado Pago is likewise forbidden. Disguised weapons: the sale of products that may be confused with firearms, even if they are harmless, such as toy guns that imitate firearms, using the Mercado Pago payment management services, is too prohibited.
Narcotics
The services offered by Mercado Pago may not be used for the sale of drugs, narcotics and toxic substances in general, as well as hallucinogenic substances and those that are considered by law and by the competent authorities to be illegal. Likewise, use of Mercado Pago for the sale of utensils or implements intended for the production, modification, processing or consumption of these goods is forbidden.
Products that depend on ratification of governmental bodies
The use of services offered by Mercado Pago is forbidden in regards to the sale of products that require prior ratification or registration and are not so ratified or registered before governmental bodies, such as, but not limited to:
Every advertisement of a product that requires prior ratification or registration with government bodies must contain, in its description, the number of the ratification or registration process with the pertinent body. Anabolics and steroids
Mercado Pago services may not be used for the sale of anabolic substances or steroids.
Stolen Property
Mercado Pago services may not be used for the sale of property or products that have been stolen, robbed or subtracted in any way. Mercado Pago undertakes to collaborate with the pertinent authorities in the investigation of products of illicit sources. If at any time such authorities request information about a product, we will inform information on the transaction and the user. Any kind of asset acquired without the authorization of its owner is considered to be stolen property.
If there is any suspicion as to any announced products as being the result of robbery or theft, immediately notify the pertinent authorities so that they can begin investigations as soon as possible.
Animals
Mercado Pago services may not be used for the sale of animals, except for the following species:
• Dogs;
• Cats;
• Fish and seafood;
• Bovines;
• Swine;
• Equines;
• Hens, chickens, roosters, ducks, turkeys and teals;
• Rabbits;
• Hamsters, opossums, guinea pigs and gerbils;
• Goats.
The use of Mercado Pago services for the sale of fish and seafood is permitted upon presentation of the breeder's license number.
The use of Mercado Pago services is equally forbidden for the sale of organs or limbs of animals, or animals that, although included in any of the above species, are in danger of extinction or have their trading forbidden by law or for any other reason.
Animal skin: Mercado Pago services may not be used for the sale of skins of endangered species or the hunting of which has been forbidden.

Counterfeit coins or banknotes
Mercado Pago services may not be used for the sale of counterfeit coins or banknotes. Included in this prohibition are tickets, checks, bonuses, transportation vouchers, food vouchers, meal vouchers that have not been issued by the pertinent authority and made available for such purposes. Replicas of banknotes or coins may be sold using Mercado Pago services when clearly stated that they are copies.

Smuggled, falsified or adulterated products
Mercado Pago services cannot be used for the sale of products that have entered the country illegally. The prohibition in question includes those products that, albeit appearing to be a legitimate product, are effectively not, or which cause confusion as to their origin, production or authenticity.
Gunpowder or explosive material
Mercado Pago services may not be used for the sale of products that contain gunpowder or explosive material of any kind, the sale of which is regulated by law and upon which restrictions are established. In cases of pyrotechnic materials, only those duly registered by the competent authorities may be offered. In addition, users that offer such products must be registered and authorized for the sale thereof. The use of Mercado Pago services is also not allowed for the sale of manuals that explain or teach how to build bombs or explosives.
Fireworks
To Mercado Pago services may not be used for the sale of pyrotechnic devices or fireworks. The term "fireworks" includes any article that contains elements and chemical compounds capable of burning, regardless of the oxygen in the atmosphere, and producing a sound, visual, mechanical or thermal effect that is usable as entertainment. Exception: Mercado Pago services may be used for the sale of pyrotechnic materials that have been duly registered with the pertinent authorities. In addition, users that offer such products must be registered and authorized to sell them.
Shares traded on the Stock Exchange and other financial products
The use of Mercado Pago services for the offering or sale of shares of companies, bonds, bills and other securities traded only on the Stock Exchange, both domestic and international, including other financial products, such as but not limited to: bank accounts, financial investments, loans etc.
Mailing list or personal database
Mercado Pago services may not be used for the sale of personal databases that include data such as: names, addresses, phone numbers, e-mails or any information that serves to individualize a person. Included in the prohibition in question is the sale of any tool or software designed to send messages by unsolicited electronic mail (SPAM), contents related to pornography, erotic or unsuitable for minors, etc. Mercado Pago services may not be used for the sale of products of pornographic, erotic nature or that are unsuitable for minors, as well as any other products or services that are contrary to morals and good customs. Contents that are considered inadequate for minors are those that include or display:
• Images of human genitals that suggest sexual activity;
• People participating in sexual relations;
• Material that is forbidden for minors;
• Materials or objects with the purpose of generating sexual excitement.
Therefore, Mercado Pago services may not be used for the offer of images, texts or content with an erotic connotation, total or partial nudity, or that have the intention to obtain the attention of the user or visitor through this resource. Excluded from the above limitations are products that are part of a publication that has not been created for sex-related purposes. It is strictly forbidden to use Mercado Pago services for the sale of any articles, goods or services when they are:
• Related to pedophilia, child pornography, nudity of minors or in any way involving minors;
• That involve forced sex, rape, snuff movies, movies or photographs that have been fixed in an illegal form, of minors or without the consent of the people who act in them;
• Services of escorts or sexual services and/or any other asset or services that are contrary to morals and good customs;
• Amateur videos and movies made with hidden cameras and/or of people that have not given consent for their recording, reproduction or distribution and that contain any kind of sexual activity.
Products that promote violence and/or discrimination
Mercado Pago services may not be used for the marketing of products that promote or incite any form of violence, crime, or any type of discrimination based on race, religion, gender, nationality, sexual orientation or any other kind, or that further include trademarks or symbols of organizations that are dedicated to the promotion of this type of practice, such as articles on the Ku Klux Klan or on the German Nazi Party.
The following are some examples of products that can be sold:
• Objects from World War II that do not show marks of Nazi groups nor of the SS or any other division of the German army;
• Books and films about World War II or Nazi Germany, even if showing the Nazi symbol;
• Documents about the war.
Products that violate intellectual property laws
Mercado Pago respects Intellectual Property rights. Thus, Mercado Pago services may not be used for the sale of products that violate laws on copyrights, patents, trademarks, models, industrial designs or industrial secrets.
Cable TV, satellite or antenna decoders. Mercado Pago services may not be used for the sale of antennas, decoding systems or devices that enable the decoding of television transmission signals by cable, antenna or satellite, unless the seller is expressly authorized by the holders of the right.
Personal documents
Mercado Pago services may not be used for the sale of products that are or could be confused with official personal documents, as well as machinery and instruments for the manufacture of this type of document or services such as the management of personal documents.
Credit or debit cards
The use of Mercado Pago services will not be tolerated for the sale of credit or debit cards, whether they are active or not. This prohibition also applies to the marketing of databases containing credit card numbers and other private information. Products for capture, memory and operation of transactions with credit cards.
Mercado Pago services may not be used for the sale of products that have the purpose of capturing and memorizing data of credit cards and of other kinds of magnetic cards. It is also expressly forbidden to use Mercado Pago services for the sale of machines with the purpose of reading card trails such as those described above, or to process credit card transactions.
Historical, artistic and cultural heritage
Mercado Pago services may not be used for the sale of products that infringe the legislation that protects assets that are artistic, of historical interest, archaeological, prehistoric, numismatic, libraries, collections of documents etc.
Hacking and cracking
Mercado Pago services may not be used for the sale of books, data CDs, tools or programs intended to introduce viruses or to hack website or electronic device.
Compilations
Compilations are understood to be programs, videos, photos, etc. extracted from the Internet or from other sources that are offered jointly in one same media support. These products can be sold with the services offered by Mercado Pago only if the author allows the sale of its work by these means.
Entertainment Tickets
Mercado Pago services may not be used for the sale of tickets for shows, sporting events and other spectacles for prices above their official prices.
Cell phone Services
Mercado Pago services may not be used for the sale of services or products that have the purpose of alteration, replacement, duplication or modification of any procedure, as well as the operation, of cellphone equipment.
This prohibition includes, but is not limited to, all services or products intended to:
• Release and/or unblock equipment, chips, SIM cards, etc.;
• Modify in any way an electronic or mechanical serial number of a terminal equipment or of user Replaceable Identification Module, on terminal equipment that is provided with such device;
• Wiretap, track or obtain unauthorized information from phone calls.
Products advertised as a joke
Mercado Pago services may not be used for the sale of any article that Mercado Pago considers to lack seriousness or to be intended to deceive.
Lottery, raffles and gambling. Mercado Pago services may not be used for the sale of lottery tickets or raffles, as well as any other article the sale of which is restricted by force of law for certain agents.
Insecticides
Mercado Pago services may not be used for the sale of insecticides, pesticides, rodenticides and other types of poisons.
Automobiles with document-related restrictions
Mercado Pago services may not be used for the sale of motor vehicles that have restrictions in their documentation, search and arrest orders and other kinds of restrictions for their circulation and ownership transfer.
Lists of suppliers, business contacts, manuals for enterprises
Mercado Pago services may not be used for the sale of items that offer instructions, business contacts or intermediation for the import or export of goods or services by means of stratagems that result in tax evasion.
This prohibition also covers any advertisement related to guides, manuals or directions for the acquisition goods or services, commercial rights or list of suppliers.
Policy for responsibility for the advertisement
Users are responsible for ensuring the legality and legitimacy of the products that they sell and to ensure that they do not infringe any existing law, and under no circumstance can they transfer such responsibility to Mercado Pago.
Mercado Pago does not assume any responsibility for the existence of transactions related to products and/or services that do not comply with this restriction.
Charity products
The use of Mercado Pago services for products for charitable campaigns will require Mercado Pago’s prior authorization, which will only be granted if it is shown that the funds collected will be destined to institutions, projects or activities with charitable and non-profit purposes and that the user does not reach for itself any economic benefit with the negotiation.
Any user who appears to promote the sale of a charitable product, or that seeks to show that the proceeds of the sale will have charitable purposes, and that has not complied with the aforementioned rule, may be disqualified from the Mercado Pago platform.
Warning
Mercado Pago may, at any time, warn, suspend or cancel users that violate any law, or the Contracts or Policies of Mercado Pago and their attachments.
The users are the only parties responsible for the products and/or services sold using the services offered by Mercado Pago. Make sure that your products or services are authentic and do not violate the applicable legislation and the Policies of the website before using the services offered by Mercado Pago. If there are any doubts as to the validity, legality and suitability of a product or service in relation to the rules of the site, do not use Mercado Pago for its sale.
